The following rules apply to the Customer Appreciation Day Contest (the “Contest”).
Some restrictions do apply to be eligible to enter or win.
In the event that Finning (Canada) a division of Finning International Inc. (“Finning (Canada)”) is barred or prohibited to run this contest, Finning (Canada) will void the contest if needed, without warning.

1. ELIGIBILITY
To be eligible to enter to win the contest, you:
Finning (Canada) has the right at any time to require proof of identity and/or eligibility to participate in the Contest. For clarity, to be eligible you do not have to be a Finning (Canada) customer to enter.
2. CONTEST PERIOD
The Customer Appreciation Day contest period begins on May 15th at 7:01 am, PST 2023 and ends on May 31st at 11:59:59 pm PST 2023.
3. HOW TO ENTER
There is no purchase necessary to enter or win the Contest.
Entries will be received between May 15th at 7:01 am, PST 2023, ends on May 31st at 11:59:59 pm, PST 2023, after which time the Contest will be closed and no other entries shall be accepted.

4. PARTICIPATION
Your participation in the Customer Appreciation Day contest is your consent for Finning (Canada), or its agents, to collect and use your name, address, and other personal information for the purposes of administering the Contest. If you decide to opt in to receive email notifications from Finning (Canada), you are also signifying your consent for Finning (Canada) to communicate with you (during the Customer Appreciation Day activity and for other uses by Finning (Canada) as permitted by law. If you do not decide to opt in to receive email notifications from Finning (Canada), you are also signifying your consent for Finning (Canada) to communicate with you for up to six months as permitted by law. Finning (Canada) is not responsible for lost, or incomplete entries as a result of, technical or mechanical malfunctions; computer hardware or software; or inaccurate entry information whether caused by equipment, programming used in the Contest, human processing error, or otherwise.
Finning (Canada) reserves the right, and discretion, to void any and all entries of an entrant whom Finning (Canada) believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest or for any other reason. Automated entry systems, in any form, are prohibited.
5. PRIZE(S)
Prizes will be awarded by random draw to qualified entrants.
Each winner of the Contest (each a “Winner”) is subject to pay all applicable duties, taxes and fees related to their geographical location.

Prize(s) cannot be exchanged for a cash equivalent or substituted for another prize. Each Contest prize has a designated retail value in Canadian dollars.
Regional prizes will be distributed or shipped by Finning (Canada) following the selection of the Winner. All prizes will be actioned within 20 business days after Winner selection.
6. WINNER SELECTION
On each of the specified draw dates, Finning (Canada) will select one (1) entrant by a random draw performed by a computer from all eligible entries received during the Contest Period. Each entrant shall be eligible to win only one (1) prize. The odds of being selected are dependent on the number of eligible entries received during the contest.
Once contacted, before being declared a Winner, the selected entrant(s) shall be required to correctly answer, without assistance of any kind, a time-limited mathematical skill-testing question.
If the selected entrant does not respond within three (3) business days (72 hours) of notification, the entrant will not receive a prize and another entrant may be selected.
Finning (Canada)’s Winner selections and decision will be final and binding in all matters relating to this Contest. Once an entrant has been selected as a Winner, they are no longer eligible for subsequent prizes.
7. PRIVACY / USE OF PERSONAL INFORMATION.
By participating in the Contest, each entrant: (i) grants to Finning (Canada) the right to use his/her personal information provided when he/she enters the Contest (collectively the “Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the Winners and coordinating the provision of the Contest prize; (ii) grants to Finning (Canada) the right to use his/her Personal Information for publicity and promotional purposes relating to the Contest in any and all media without further compensation unless prohibited by law; and (iii) acknowledges that Finning (Canada) may disclose his/her Personal Information to third-party agents and service providers of Finning (Canada) in connection with any of the activities listed in (i) and/or (ii) above.
Finning (Canada) will use each entrant’s Personal Information only for identified purposes and protect each entrant’s Personal Information in a manner that is consistent with Finning (Canada)’s Data Governance Statement which can be found here: https://www.finning.com/en_CA/policies/data-governance.html
8. MISCELLANEOUS RULES
a. Any taxes and any other expenses not specified herein are the Winner’s sole responsibility. The Winner may be required to execute and return an Affidavit of Eligibility, Liability Release within 7 days of issuance of prize notification. Noncompliance with any of the rules as outlined in this Contest may result in disqualification.
b. Finning (Canada) has the right to disqualify any entry or entrant, and to modify, terminate or suspend this Contest. Finning (Canada) is the only and final arbitrator (this means referee or judge) of any disputes regarding this Contest, any entry and/or any official rule or eligibility requirement.
c. All entries become the property of Finning (Canada), and Finning (Canada) assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries.
d. Entrants may be required to provide reasonable proof that they meet the requirements of the Contest.
9. AGREEMENT, CONSENT AND RELEASE
By participating, entrants and Winner agree:
a. to follow these Contest rules;
b. Finning (Canada), as well as Finning (Canada)’s subsidiaries, agents and sponsors, have the right and permission to use the entrants and Winner’s name, voice, place of residence, photograph (and or/likeness), as well as any statements the entrant or Winner made regarding the prize, for: advertising, and/or trade, and/or any other purpose worldwide, forever and ever, and in any other media or format, without any form of compensation, permission, or notification, and
c. that Finning (Canada), and Finning (Canada) subsidiaries, sponsors and agents, and all of their respective officers, directors, employees, representatives, successors and assigns shall have no liability to entrants and Winner(s) and are held harmless and indemnified by entrants and Winner(s) for any liability, loss, injury, claim, or damage to themselves or any other person or entity, including but not limited to, personal injury, death, or damage to personal or real property, to entrant, Winner(s) (and guest if applicable) or any other person or entity due in whole or in part, directly or indirectly by reason of the acceptance, possession, use or misuse of a prize or participation in the Contest.
