Fuel Promise Program Terms & Conditions: Finning is offering the “Fuel Promise Program” (“the Program”) through its partner Caterpillar. The Fuel Promise Program is offered to customers who (i) purchase a new machine from Finning (specific models are excluded from the Program, speak to your Finning Sales Rep for further details), (ii) have Product Link installed and activated on the machine within 60 days of purchase and, (iii) enter into a Finning Customer Value Agreement (CVA). The Program is strictly subject to full terms and conditions as set out fully in the CVA. The Program defines an expected level of fuel consumption specific to each machine model. Caterpillar will use Product Link data to monitor average fuel consumption rate against the expected fuel consumption rate. Remedies for exceeding the expected fuel consumption rate are limited solely to a parts and service credit and any such credit is limited to a defined cap. Finning nor Caterpillar are responsible for any lost profit, downtime or any incidental or consequential damages. All machine sales are strictly subject to Finning Standard Conditions of Sale and Supply and the machine must be operated and maintained strictly in accordance with the Caterpillar Operation and Maintenance Manual to remain eligible under the Program. The Program is subject to a maximum duration period of 36 months or 6000 hours usage. The Program is only available to the original purchaser of the machine, it is non-transferable and is subject to regular review by Caterpillar who reserve their right to amend the terms or terminate the Program at any time.
